Warranty
Subject to the conditions set out below, Pioneer 4x4 Limited warrants that its Goods will correspond with their specification and will be free from defects in material and workmanship at the time of delivery.
Pioneer 4x4 Ltd shall be under no liability in respect of any defect arising from:
— Fair wear and tear, wilful damage, negligence, or abnormal operating conditions.
— Failure to follow Pioneer 4x4 Ltd instructions, or misuse of the Goods.
— Alteration or repair carried out outside of Pioneer 4x4 Ltd premises.
— Use of the Goods in racing or competition conditions, or modifications made to them.
— Non-payment: no warranty claim will be accepted where the full price of the Goods has not been paid by the due date.
— Goods not of Pioneer 4x4 Ltd manufacture. Such Goods are sold subject to the conditions and guarantee (if any) of their manufacturer.
Any claim based on a defect in the quality or condition of the Goods, or their failure to correspond with specification, must be notified to Pioneer 4x4 Ltd within a reasonable time of discovering the defect.
Where a claim is accepted, the Goods must be returned to Pioneer 4x4 Ltd premises within 30 days of us confirming the claim, carrier paid. Failure to return the Goods within this period will render the claim void.
If Pioneer 4x4 Ltd accepts the claim, we will at our discretion replace the Goods free of charge or refund the purchase price. No further liability will be accepted. Goods made to special order may not be returned unless defective.
Pioneer 4x4 Ltd may, at its sole discretion, accept the return of Goods for credit, provided:
— The Goods are returned to Pioneer 4x4 Ltd, carrier paid, in unused and resaleable condition, within 28 days of delivery.
— A restocking charge of up to 20% may be levied at Pioneer 4x4 Ltd’s sole discretion.
Except in respect of death or personal injury caused by Pioneer 4x4 Ltd’s negligence, Pioneer 4x4 Ltd shall not be liable for any indirect, special or consequential loss or damage (including loss of profit), costs, expenses or other claims for compensation, whether caused by the negligence of Pioneer 4x4 Ltd, its employees, agents or otherwise, arising out of or in connection with the supply, use or resale of the Goods.
The entire liability of Pioneer 4x4 Ltd under or in connection with any contract shall not exceed the price of the Goods concerned.
Where the Goods are sold under a consumer transaction, your statutory rights are not affected by these conditions. Nothing in this warranty limits or excludes any liability that cannot be excluded by law.
